1. KCCNFM100 Wants to send you on a One-Night Getaway To Aulani, a Disney Resort and Spa in Ko`olina
Rules for all promotions available for inspection at the Cox Radio Hawaii offices.
As a condition of playing the contest and by accepting prize, winner agrees to grant to Cox Media Group (KCCN FM100, Hawaiian 105 KINE, Krater 96, Power 104.3) and its licensees, affiliates and assigns, the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web at any time or times, the winner's name, portrait, picture, voice, likeness and biographical information as news or information and for advertising and promotional purposes without additional consideration; and further without such additional compensation, appear for any presentation or other activity which may include filming/audio/video/electronic or other recordings and/or interviews, as may be determined from time to time by Cox Media Group
2. ELIGIBILITY
The KCCNFM100 “Wants to send you on a One-Night Getaway To Aulani, a Disney Resort and Spa in Ko`olina” is open only to O`ahu Residents.
Employees of Cox Media Group (KCCN FM100, Hawaiian 105 KINE, KRTR 96, Power 104.3) and all of the related companies and their immediate family members (spouse or significant other, mother, father, sister, brother, daughter son) or anyone residing in their household is not eligible.
You must be 18yrs or older with a valid credit card and ID.
By participating, you agree to these Official Rules and the decisions of Cox Media Group and or Aulani, a Disney Resort and Spa in Ko`olina which are final and binding in all respects.
No Purchase is ever necessary to participate in any of our contests or games.
3. PRIZES
Prizes cannot be assigned or transferred. Prizes are non exchangeable and there is no cash redemption value.
There will be Two one-night getaways to Aulani, a Disney Resort and Spa in Ko`olina
(a)The Vacation Packages awarded by the Station must be completed by December 15, 2012. Vacation Package fulfillment is subject to certain restrictions including availability of accommodations the Resort. Advanced reservations required. Winners must be at least eighteen (18) years of age to win. Travelers under the age of eighteen (18) must be accompanied by a parent/legal guardian who is at least eighteen (18) years of age. Vacation Package and components may not be sold, redeemed for cash, traded, transferred, or rescheduled to dates other than as set forth above. Certain travel restrictions apply. Saturday night stay may be required. Room accommodations consisting of one (1) standard room (with a maximum of four (4) persons per room) for one (1) night at the Resort (as selected by Disney in its sole determination).
(b)Certain restrictions shall apply to the Vacation Packages, which restrictions shall be determined by Disney in its sole and absolute discretion. Each winner and his/her guests must travel together on the same itinerary. The Vacation Packages shall not include the following: Excursions, entertainment and other activities at or arranged by the Resort; airport departure fees and taxes, baggage fees, travel insurance; hotel room service; parking fees; laundry service; food; alcoholic beverages; merchandise, souvenirs, etc.; local and long distance telephone calls; tips, gratuities, service charges; or all other charges not explicitly included in the packages pursuant to this Agreement. The Vacation Packages (and all elements thereof) are not redeemable for cash and are non-transferable except in Disney’s sole and absolute discretion. The Vacation Packages may not be sold or transferred to any other person or third party.
(c)The estimated retail value of each vacation package is three hundred ninety-nine dollars ($399.00). Disney, its parent, subsidiary, related and affiliated companies and their respective officers, directors employees and agents shall be released and discharged from any and all legal claims, losses injuries, demands, damages, actions, and /or causes of actions which arise out of and/or in any way related to the prize, the receipt, use and/or enjoyment of the prize and/or the Promotion.
Cox Media Group reserves the right, at its sole discretion, to revoke any prize awarded and to disqualify any individual it finds, to be tampering with the entry process or the operation of the contest; to be in violation of the Terms of Service of the contest, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner including theft or behavior with intent to annoy, abuse, threaten or harass any other person.
Cox Media Group will prosecute any fraudulent activities to the full extent of the law.
Prizes not used within the allotted time period as deemed by Aulani, a Disney Resort and Spa in Ko`olina are immediately forfeited and no other prizes will be awarded.
5. TAXES
Any & all taxes are the sole responsibility of winner. Winners must execute and return an Affidavit of Eligibility, a Liability Release, and a Publicity Release within 7 days of notification. Failure to return documents timely, or if prize notification or prize is returned as non-deliverable, may result in disqualification.
6. LIABILITY
By accepting the prize, each winner agrees to release and hold harmless Cox Media Group its licensees, their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, the use or misuse of a prize, participation in any contest related activity, or participation in this contest.
Cox Media Group is not responsible for any incorrect or inaccurate information, whether caused by the material, equipment or programming associated with or utilized in the contest and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the phone line.
8. DISPUTES
As a condition of participating in this Promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in the City of Honolulu having competent jurisdiction, which Court shall apply the laws of the State of Hawaii without regard for doctrines of Conflict of Law. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Promotion), and participant further waives all rights to have damages multiplied or increased.
